The studies included in the book were prepared before or at the onset of the ongoing COVID-19 pandemic and the unfolding economic crisis; yet they provide cursory observations on its likely impact, and underscore how the stated principles and policies of an inclusive growth strategy have become even more significant in the present situation. Bangladesh has been growing respectably during the past decade and a half and has arguably shown strong progress in several social indicators. However, inequality and vulnerability are rising alarmingly, and the economy is beset with high levels of corruption, as well as with various other governance deficits that can adversely affect future growth and social inclusion. The book provides a critical assessment of how far growth in Bangladesh has been inclusive, both over time, and in comparison to selected South and Southeast Asian countries. It constructs a specific 'inclusive growth index' with reference to what the study considers as the significant goals and pillars of inclusive growth. Bangladesh is not the only developing country that is faced with the arduous task of tackling unbalanced economic growth and of implementing the 2030 Agenda. The Contestation of Expertise in the European Union

This book examines the position and role of expertise in European policy-making and governance. At a time when the very notion of expertise and expert advice is increasingly losing authority, the book addresses these challenges by empirically examining specific administrative processes and institutional designs in the European Union. The first part of the volume theorizes expertise and its contestation by examining accounts of the legitimate institutional design of knowledge production processes and exploring the theoretical links of Europeanisation and expertise. The second part of the book delves into empirical institutionalist accounts of expertise and maps the role of experts in a variety of EU institutions but also explains the implications when EU bodies themselves are in an 'expert' position, such as agencies. The book offers insights into how individual experts deal with the challenge of producing reports that will be heard by policy-makers, while at the same time preserving their independence. Broadening its scope, the book then expands the analysis to the role of advisory committees in light of the shift from a reliance primarily on in-house expertise to including more external experts in advisory groups in the European Commission and European Parliament as well as at the European External Action. In the third part, the book opens the lens to developments beyond the EU by taking into account two highly pertinent fields: climate change and trade. Coordinated attacks in Europe, as in the West, provide adequate reason that, 21st century is an era of sectarian movements, violent extremism, jihadist tendencies and global terrorism. Can Blockchain Solve the Hold-Up Problem in Contracts?

A vexing problem in contract law is modification. Two parties sign a contract but before they fully perform, they modify the contract. Should courts enforce the modified agreement? A private remedy is for the parties to write a contract that is robust to hold-up or that makes the facts relevant to modification verifiable. Provisions accomplishing these ends are renegotiation-design and revelation mechanisms. But implementing them requires commitment power. Conventional contract technologies to ensure commitment - liquidated damages - are disfavored by courts and themselves subject to renegotiation. Smart contracts written on blockchain ledgers offer a solution. We explain the basic economics and legal relevance of these technologies, and we argue that they can implement liquidated damages without courts. We address the hurdles courts may impose to use of smart contracts on blockchain and show that sophisticated parties' ex ante commitment to them may lead courts to allow their use as pre-commitment devices.

Re-Invigorating Ubuntu Through Water

This book argues for the existence of a court enforceable human right to water that is implied from the right to life in Article 6 of the Namibian Constitution.The book builds this argument by using tools of constitutional interpretation and with the aid of comparative materials. As such, the African value of ubuntu is invoked. Ubuntu - which is legally developed through its four key principles of community, interdependence, dignity and solidarity - is anchored in a novel approach to Namibian constitutional interpretation that is conceptualised as 're-invigorative constitutionalism'. The book advances the 'AQuA' (adequacy - quality - accessibility) content of water and articulates the correlative duties within the context of the respect - protect - fulfil trilogy, which are duties imposed upon the Namibian state as the primary duty bearer for a right to water. These duties include irreducible essential content duties that are argued to be immediate when compared to general obligations. In giving substance to duties that flow from a right to water, international law interpretative resources are also relied upon, including General Comment No 15 by the United Nations Committee on Social, Economic and Cultural Rights, the African Commission's Principles and Guidelines on Social and Economic Rights, and the World Health Organisation's Drinking-water Quality Guidelines. Moreover, the book addresses various justiciability concerns that may arise, arguing that Namibian courts are institutionally competent and legitimate in enforcing right to water claims through the application of the bounded deliberation model. Most of the recent academic literature has focused on the broader picture or, in other words, the macro politics of the Kurdish conundrum within Iraq and beyond. There is little scholarship about the Kurdish population and their socio-economic conditions after 2003, and almost none about the younger generation of Kurds who came of age during autonomous Kurdish rule. This is a generation that, unlike their forebears, has no direct memory of the decades-long campaigns of repression. Studying and examining the rise of this generation of Kurdish young millennials-"Generation 2000"-who came of age in the aftermath of the United States invasion of Iraq offers a unique approach to understand the dynamics in a region that underwent a substantial socio-political transformation after 2003 as well as the impact of these developments on the youth population. What would happen if a country were to move from using GDP to using subjective wellbeing as the primary metric for measuring economic and societal progress? Would policy priorities change? Would we continue to care about economic growth? What role would different government institutions play in such a scenario? And, most importantly, how could this be implemented in daily practice, for example in policy evaluations and appraisals of government analysts, or in political agenda-setting at the top level? This volume provides answers to these questions from a conceptual to technical level, by showing how direct measures of subjective wellbeing can be used for policy evaluation and appraisal, either complementary in the short-run or even entirely in the long-run.
