Particularmente desde una perspectiva probatoria la conducta de las partes ha alcanzado una notoriedad en cuanto a su relaci籀n con el llamado deber de buena fe procesal o tambi矇n conocido como principio de moralidad procesal. En este sentido, se afirma que la conducta procesal de las partes que contrar穩e los imperativos abiertos e indeterminados que se deducen de la buena fe y moralidad procesal (entre ellos la colaboraci籀n), puede llegar a transformarse en elemento de convicci籀n para que el juez decida el fondo de la causa, bien como elemento corroborante de prueba o como un elemento suficiente para la acreditaci籀n-desacreditaci籀n de los hechos controvertidos, participando, adem獺s, en la categor穩a de sanci籀n a la parte que no colabora con la b繳squeda de la justicia y la verdad. En atenci籀n al poder general que se le otorga al juez, bien por v穩a normativa (norma expresa) o bien por v穩a de construcci籀n de normas (inexpresas). Todo esto, a nuestro parecer, bajo una falta de rigor y racionalidad en cuanto al contexto donde se utiliza este tipo de tesis: el proceso. As穩 pues, entendemos que el proceso es m矇todo, espec穩ficamente un medio pac穩fico de debate dial矇ctico entre dos antagonistas en perfecto pie de igualdad (para descartar el uso de la fuerza) ante un tercero (que, como tal, es impartial, imparcial e independiente) que heterocompondr獺 el litigio si es que no se disuelve por alguna de las v穩as posibles de autocomposici籀n. La idea dial矇ctica del proceso como medio o m矇todo de debate, permite una claridad previa para iniciar una discusi籀n sobre temas controversiales. La prueba es uno de esos temas, m獺s aun cuando se la relaciona con la conducta de las partes dentro de este m矇todo (el proceso). Sin desconocer que el proceso genera una relaci籀n jur穩dica (von B羹low), as穩 como tambi矇n situaciones jur穩dicas (Goldschmidt), decir que el proceso es un m矇todo de debate dial矇ctico, en el sentido antes enunciado, permite una claridad previa para su estudio. Como m矇todo se manifiesta con rigor y para que siga siendo lo que est獺 llamado a ser debe observar principios. Para que el proceso pueda ser identificado como una categor穩a jur穩dica 繳nica e irrepetible de cualquier otra forma que exista de solucionar conflictos, se hace menester formular principios necesarios para lograrlo (lo que) implica tanto como trazar l穩neas directivas fundamentales que deben ser imprescindiblemente respetadas para lograr el m穩nimo de coherencia que supone todo sistema. La buena fe procesal, entendida como principio (principio de moralidad procesal), es a menudo justificada desde un concepto m獺s amplio de buena fe, fundamentalmente desde aquel concepto del derecho privado e incluso, como una m獺xima que debe gobernar todo tipo de relaci籀n jur穩dica; por ejemplo se簽ala Chiovenda que lo mismo que cualquier relaci籀n jur穩dica o social, la relaci籀n procesal debe ser regida por la buena fe.
