This is a best practices manual for advocates attempting to influence lawmaking by executive branch agencies, that is, the adoption of rules and regulations enforceable on the public. This book rests on four foundations: "The execution of laws is more important than the making of them." (Thomas Jefferson) Agencies make administrative law to implement statutory. Rather than ending a process, a statute initiates a constitutional process, that is, agency adoption of administrative laws. Administrative laws, that is, rules and regulations implement legislative laws. Statutes are dead letters until the agency promulgates rules.You don't have a law until the agency tells you that you have a law. And you don't know what a law means until they tell you what it means. Agencies do both via rulemaking. Agency interpretation and application of legislative law via rulemaking constitute the real law. They are last in law making process making them first in authority. And agencies adopt many rules.For every one page of broad legislature-made law, agencies can make ten pages of highly detailed agency-made law. The law as applied is found in the minutiae of administrative rules through which agencies can implement or redirect legislation. In other words, 90 percent of the body of law regulating your principal(s) is written by executive branch agencies. Through rulemaking what the legislature gave, an executive agency can take away, and what the legislature wouldn't give, an executive agency might. For example, using agency discretion an agency can promulgate rules that extend benefits to one group to the exclusion of another.And, to support the administrative state, taxpayers invest billions of dollars per year to employ and equip millions of state government workers. Each state has from dozens to hundreds of regulatory agencies, departments, boards, and commissions that implement public policy and adoptand enforce regulations using legislatively delegated authority. They are the modern administrative state.In terms of money, staff numbers, reach, and authority the administrative state dwarfs the executive, legislative, and judicial branches combined. While the legislative, executive, and judicial branches pursuant to the federal and state constitutions are coequal, in functional reality, the disproportionate size, power, wealth, and reach of the administrative state are so substantial that, since the 1930s, the administrative state has been called "the headless fourth branch of government." The strategies, skills, and techniques provided by this manual equip practitioners to achieve for their principals the best regulatory environment possible from the administrative state.

Organized Civil Servants
In the early 1960s, the militant demands of some organizations of state and local government employees to participate in decisions about compensation and conditions of employment challenged many established concepts of public administration. A series of strikes revealed a lack of public policy and administrative techniques to cope with the problems presented by aggressive and innovative groups of public employees. Although civil servants had been organized in some communities for as long as fifty years, public attitudes about how such organizations should fit into the political and administrative systems were hazy in the 1960s, and official policies were fragmentary or nonexistent. Some states adopted legislation forbidding public employees to join certain types of organizations. Some highly industrial and urban states enacted legislation creating a system of employer-employee relations based on the theory of collective bargaining developed in industry. California, the most populous state, developed a public policy that differs considerably from the industrial model. In Organized Civil Servants, Winston W. Crouch analyzes factors in California's political system that have tended to produce this policy. He also analyzes the efforts made to reconcile collective bargaining in the public service with the established concepts and procedures of the merit system of public employment. The ultimate outcome appears to depend on the scope of agreements negotiated between public employers and employee organizations at the bargaining table. Exploring Political Legacies
The concept of the political legacy, despite its importance for institutionalist and historically-minded political analysts more generally, remains both elusive and undeveloped theoretically. This book seeks to address that oversight by building on existing studies which have approached the notion of a legacy to offer a clear definition and operationalisation of the term which might be used to inform future research. New Perspectives on Well-being and Global Inequality since 1820, presents new estimates of working hours, biodiversity loss, social spending and GDP (accounting for the 2011 round on purchasing power parities) as well as measures of inequalities in wealth, longevity and educational attainment, gender disparities and extreme poverty. Faces and Phases of Colonialism in Africa
There is a spectre of anger and disgust surrounding oppressive, inhumane and exploitative practices that have been perpetrated by some against others throughout human history. This anger goes beyond the attendant psychological, economic and political damage to include the significant psychological burden it bears on those who are not direct victims but acknowledge such practices as horrendous and empathize as a result. For Africans and its descendants throughout the world, there is a spectre of subjugation that lives on in the continent and within African communities that is not always obvious even in its most overt forms. This spectre goes by the name colonialism or imperialism, runs through different channels and benefits from the complicity of individuals, groups, governments, corporations and institutions. So many centuries have passed since exploitation, domination and subjugation first began on the continent by people from far-flung territories. While such adventures are theoretically known to be a thing of the past, its practices are far from being over. Through acts of unprecedented suspicion, imperialism established itself by imposing new rules, principles and ways of life that force people to regress and turn in circles on the same spot. The official independence of African countries was seen as a source of hope by many, but this too was sullied at its inception and the redemption of both the hunted and the hunter now hangs on a balance.
Federalism and National Diversity in the 21st Century
This edited volume explores the obstacles to and opportunities for the development and entrenchment of a sustainable and representative multinational federalism. In doing so, it tackles a striking puzzle: on the one hand, scholars agree that deeply diverse multinational and multiethnic democracies should adopt federal structures that reflect and empower territorially concentrated diversity. On the other hand, there are very few, if any, real examples of enshrined and fully operative substantive multinational federalism. What are the main roadblocks to the adoption of multinational federalism? Can they be overcome? Is there a roadmap to realizing multinational federalism in the twenty-first century? In addressing these questions, this book brings together scholars from across the globe who explore a diverse range of cases from different and innovative analytical approaches. The chapters contribute to answering the above questions, each in their own way, while also addressing other important aspects of multinational federalism. The book concludes that the way forward likely depends on the emergence of a specific set of norms and a receptiveness to the complex institutional design.
The Permanence of Temporary Urbanism
Temporary urbanism has become a distinctive feature of urban life after the 2008 global financial crisis. This book offers a critical exploration of its emergence and establishment as a seductive discourse and as an entangled field of practice encompassing architecture, visual and performative arts, urban regeneration policies and planning. Drawing on seven years of semi-ethnographic research, it explores the politics of temporariness from a situated analysis of neighbourhood transformation, media representations and wider political and cultural shifts in austerity London. Through a longitudinal engagement with projects and practitioners, the book tests the power of aesthetic and cultural interventions and highlights tensions between the promise of vacant space re-appropriation and its commodification. Against the normalisation of ephemerality, it presents a critique of the permanence of temporary urbanism as a glamorisation of the anticipatory politics of precarity which are transforming cities, subjectivities and imaginaries of urban action.

Religious Parties and the Politics of Civil Liberties
A data-driven explanation of when successful religious parties reduce the civil liberties of their citizens in Muslim-majority countries and when they don't. Religious parties are increasingly common across the world. More and more, they participate in elections, win legislative seats, and join governments, particularly in Muslim-majority countries. Since they are often founded on orthodox principles that are inconsistent with liberal democracy, their rise potentially holds consequences for the prospects of liberal democratic values and practices-and this risk has inspired much heated debate. In Religious Parties and the Politics of Civil Liberties, the award-winning political science scholar Vineeta Yadav considers a question that has been central to the discussion: Will the success of religious parties lead to declines in the civil liberties of their citizens? Yadav summarizes the popular and academic sides of the conversation and addresses the weaknesses of both by presenting an original empirical analysis of religious parties' actual relationship to civil liberties. Many believe that if religious parties come to power, they will curb civil liberties in order to realize their religious visions. Academic research on religious parties, however, claims that the need to compete in elections incentivizes religious parties to moderate their behaviors and policies, including on civil liberties. Neither of these assertions has been systematically tested until now. With this book, Yadav adjudicates the debate using systematic data that covers all Muslim-majority countries for a period of almost forty years. Community Land Trusts and Informal Settlements in the Global South
During the fifty years since the first community land trust (CLT) was founded by African-American civil rights activists in the United States, CLTs have spread far beyond their country of origin. Most of this growth has occurred in the Global North, but CLTs are now also being formed in a growing number of countries in the Global South. The fertile seedbed for CLT development in this part of the world has been informal settlements. These are residential areas where people have built their own homes, usually without regard for whatever governmental standards, codes, or regulations that might exist. They have sited their self-built homes, moreover, on lands to which they lack a legal right of ownership or occupancy. Many of these settlements have existed for several generations. Buildings, community ties, and a way of life have become firmly established, even as the residents' tenure has remained precarious.Community land trusts are being promoted by community activists in the Global South as a resident-led strategy for formalizing tenure and securing people's homes in communities like these. Several chapters in the present monograph focus on the formation or exploration of CLTs in urban areas, including densely populated informal settlements in San Juan, Puerto Rico; Rio de Janeiro, Brazil; Voi, Kenya; Karachi, Pakistan; and Dhaka, Bangladesh. Another chapter focuses on a remote rural area of Honduras, where a CLT is working to secure the watersheds on which widely dispersed mountain villages depend. All of the monograph's chapters, except for the opening essay by Patricia De Toledo Basile and Meagan M. Ehlenz, were selected from On Common Ground: International Perspectives on the Community Land Trust. This earlier collection of twenty-six original essays was published by Terra Nostra Press in June 2020.

The Ubiquitous Presidency
American democracy is in a period of striking tumult. The clash of a rapidly changing socio-technological environment and the traditional presidency has led to an upheaval in the scope and standards of executive leadership. Yet research on the presidency, although abundant, has been slow to adjust to changing realities associated with digital technologies, diverse audiences, and new elite practices. Meanwhile, journalists and the public continue to encounter and shape emerging presidential efforts in deeply consequential ways. Joshua Scacco and Kevin Coe bring needed insight to this complex situation by offering the first comprehensive framework for understanding contemporary presidential communication in relation to the current socio-technological environment. They call this framework the "ubiquitous presidency." Relational Well-Being in Policy Implementation in Mexico
This book provides key insights into the nature of officer-recipient relationships and shows how they have non-negligible impacts on the way recipients feel and think about themselves and their lives using mixed methods and subjective and psychosocial well-being approaches.
